Terms governing the use of the HUBI application

1. General

  1. By using the Hubi application, you acknowledge, understand, and agree to these terms of use.
  2. These terms of use ("Terms") apply to the use of the Hubi application and website ("Application") provided by GeoPass Company Oy ("We", "Us").
  3. The Application is a platform through which third parties ("Event Organizers") inform about their events and sell tickets to them. Each event, its ticket sales, and the use of this Application for the aforementioned purposes are always the responsibility of the Event Organizer. We are responsible for the technical implementation of the Application and its availability.
  4. All rights to the Application belong to Us, and We reserve the right to make changes to these Terms and the Application unilaterally. By using the Application, you agree to abide by these Terms as they are in force at any given time.
  5. We provide the Application as it is available. This means that we do our best to ensure the functionality of the Application, but we cannot guarantee its correctness or uninterrupted use. Therefore, we cannot be held responsible for any indirect or direct damages caused by the malfunction, inaccuracy, or interruption of use of the Application.

2. Age Limit

The Application is available to users who are at least 13 years old. If you are under 18 years old, you must have parental consent to use the Application. By using the Application, you confirm that you meet these requirements. Tickets to events with an age limit of 18 may be sold through the Application. We do not market such content to users under 18 years old. Therefore, it is important that you are honest about your age when using the Application.

3. Registration and Use of the Application

  1. You have the option to create an account in the Application. Creating an account is voluntary and requires registration. You are responsible for the accuracy of the personal information you provide, for keeping your account credentials secure, and for all activities that occur on your account.
  2. We also reserve the right to deny your registration and use of the Application without prior notice.

4. Collection and Use of Information

We collect and process personal data in accordance with our privacy policy. By using the Application, you consent to the collection and use of your personal data as described in the Privacy Policy.

5. User Responsibilities

  1. You agree to use the Application in accordance with applicable laws and regulations and to refrain from activities that may disrupt or endanger the operation or security of the Application. You are solely responsible for the content you submit, transmit, or display through the Application, including any rights you have in the images you upload to the Application.
  2. You agree to provide truthful personal information about yourself. The Event Organizer has the right to cancel the reservation you made or the ticket you purchased if it is found that you have not provided accurate personal information (e.g., a ticket purchased by a minor for an event that requires adulthood).

6. Intellectual Property Rights

  1. The Application and its content such as text, graphics, logos, and software are owned or controlled by GeoPass Company Oy, the Event Organizer, or a third party. You may only use the Application for the agreed purpose. You may not copy, modify, distribute, or exploit the Application for any other purpose.
  2. By adding content to the Application, you grant us a non-exclusive, worldwide license to use, reproduce, modify, and display that content for the purpose of providing, promoting, and improving the Application.

7. Event Organization and Ticket Purchase

  1. The Event Organizer may sell tickets to their events through the Application. The Event Organizer is responsible for organizing the event and selling tickets independently. We are never a party to the event and are not responsible for its organization or ticket sales.
  2. The Event Organizer is responsible for the marketing of the event and the accuracy of the information provided in the Application. The Event Organizer is also responsible for offering, pricing, and eligibility of tickets for the event. We do not receive ticket sales revenue on behalf of the Event Organizer; instead, the price you pay for the ticket goes directly to the Event Organizer. Therefore, we are not responsible for the cancellation of the event or the refund of the ticket price paid by you; this is also the responsibility of the Event Organizer.
  3. The Event Organizer may limit the number of tickets sold per person, prohibit ticket resale, or cancel a ticket already sold if it has been obtained by fraud or false personal information. The Event Organizer may also deny the ticket holder access to the event, for example, due to the absence of a discount-entitling document (e.g., student ID or identity card). The Event Organizer is solely responsible for such actions.
  4. The ticket price is stated before making the purchase. The ticket price is the share received by the Event Organizer from your payment. In addition to the ticket price, we separately disclose a service fee ("Service Fee") that we charge for using the Application to purchase the ticket. The ticket price and the Service Fee are also uniformly disclosed as the total price ("Total Price"). The Total Price is the sum you pay in full when purchasing the ticket through the Application. The Total Price includes the ticket price, the Service Fee, and any taxes and government fees included therein.
  5. The Service Fee is non-refundable, even if the event is canceled or you are otherwise entitled to a refund from the Event Organizer.
  6. Once you have paid for the ticket, we will deliver it digitally to the Application and/or to the email address you provided as a link. You have no other way to obtain the ticket. Upon receiving the ticket, please check it and keep it carefully.
  7. Third-party payment processing services are used in the payment transaction. Unfortunately, we cannot be held responsible for any disruptions in payment processing. We are not liable for any direct or indirect damages resulting from such disruptions.
  8. The purchase of a ticket may be interrupted due to a telecommunications disruption. While these problems are regrettable, we cannot be held responsible for any direct or indirect damages resulting from them.

8. Changes and Cancellations of Tickets and Events

  1. The events presented in the Application may be subject to changes or cancellations. We are not responsible for changes, cancellations, or damages resulting from changes or cancellations of the event. The Event Organizer is responsible for ticket sales and event organization and thus also for event cancellations, content, schedule, and other changes, as well as for informing about them and compensating for them.
  2. If you need to change or cancel a ticket, please contact the Event Organizer directly. We do not accept ticket revenues and therefore do not refund the ticket price you paid.

9. Dispute Resolution and Jurisdiction

This agreement is governed by Finnish law. Disputes between the customer and the Event Organizer are handled between them. Disputes regarding these Terms or the use of the Application are primarily resolved through negotiations and ultimately in the competent district court. Before bringing the matter to the court's attention, consumer customers have the option to bring the matter to the Consumer Disputes Board (kuluttajariita.fi) or seek advice from the Consumer Advisory Services (https://www.kkv.fi/kuluttaja-asiat/kuluttajaneuvonta/).

10. Third-Party Services in the Application

The Application may integrate with or link to third-party services. These third-party services are subject to their own terms of use and privacy policies.
